These Terms of Use ("Terms") govern your use of Market Posture ("the App"), an iOS application published by SignalDeck. By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
1. What the App Is
Market Posture reports a market-regime reading derived from daily price and volume across a fixed set of publicly traded US exchange-traded funds and index series. The reading is a plain majority of four measured relationships — high-yield credit against its 50-day average, cyclical against defensive sector performance, volatility against its own trend, and small-cap against large-cap performance.
2. What the App Is Not
The App is not investment advice, and nothing in it is a recommendation to buy, sell, or hold any security. Specifically:
- It is not a forecast. Every figure the App displays is backward-looking — a close measured against a prior close, a volume measured against its own average. Nothing in the App predicts the next move of any market.
- It is not personalised. The reading is identical for every user. It knows nothing about your positions, your account, your risk tolerance, or your objectives, and could not tailor itself to them if it tried.
- It is not complete. The App reads a fixed universe of liquid US-listed ETFs and four index series. It does not cover individual stocks, international equities, the wider rates curve, currencies, or digital assets.
- It is not real-time. The standard reading is anchored to the last completed trading session. The Pro premarket reading uses delayed data and displays its own age; the App discards any quote older than twenty minutes rather than presenting it as current.
- We are not your broker or adviser. SignalDeck is not a registered investment adviser, broker-dealer, or financial planner. Using the App creates no advisory or fiduciary relationship. Trading involves risk of loss, including loss of principal.
Any decision you make after looking at the App is yours alone. You should consider seeking advice from a licensed professional before making financial decisions.
3. Data Accuracy
Market data is sourced from third-party providers and delivered through SignalDeck's own service. We take reasonable care that the App computes and displays that data faithfully, and the App is deliberately built to say so when a reading cannot be produced rather than showing a neutral-looking result you might mistake for a calm market. Even so, market data can be delayed, incomplete, revised, or wrong, and we make no warranty as to its accuracy, completeness, or timeliness.
4. Subscriptions
- The App offers an optional Pro subscription at $7.99 per month or $69.99 per year, each with a 7-day free trial for new subscribers.
- Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the end of that period.
- You can manage and cancel subscriptions in your App Store account settings. Any unused portion of a free trial is forfeited when you purchase a subscription.
- All billing is handled by Apple. We cannot process refunds; use Apple's Report a Problem page.
5. Advertising
The Free tier is supported by non-personalized banner advertising served by Google AdMob. Any paid subscription removes advertising entirely. See our Privacy Policy for what this does and does not involve, and our Privacy Choices page for your controls.
6. Acceptable Use
You may use the App for your own personal purposes. You may not resell, redistribute, or systematically extract the data the App displays, attempt to circumvent the subscription verification that protects the paid data tier, or reverse-engineer the App except to the extent that restriction is unenforceable under applicable law.
7. Availability
We may change, suspend, or discontinue any part of the App at any time, including the market data service it depends on. We aim to give reasonable notice of material changes affecting paid subscribers.
8. Disclaimer of Warranties & Limitation of Liability
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, SignalDeck is not liable for any trading losses or for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the App. Where liability cannot be excluded, it is limited to the amount you paid us for the App in the twelve months preceding the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.
9. Changes to These Terms
We may update these Terms. Material changes will be reflected in the "Last updated" date above and, where they affect subscribers, noted in the App Store "What's New" notes.
